GENERAL TERMS AND CONDITIONS OF SALE AND DELIVERY OF BOUVARD FLEURS SA IN GENEVA.

ART.1 -  PRODUCTS/ITEMS

Our images and descriptions of bouquets, arrangements, plants and flowers are published for information only. Their purpose is to show examples and samples of our fresh products in order to give our customers the opportunity to choose one of our articles. We reserve the right to modify them according to availability and the arrival of flowers. We make every effort to ensure that the shape of the bouquet or plant resembles the image as closely as possible, as we work with a natural product, the flower, which is perishable and exhaustible. On the flower market, certain products are sometimes unavailable, forcing us to choose an alternative to produce the bouquet. We attach great importance to the freshness and quality of our flowers and refuse to compromise on this point. We endeavour to produce arrangements as close as possible to the images, without being held responsible for any alterations to the arrangements. We assume that our customers agree with this position and cannot accept complaints about changes in the choice of flowers or aesthetic changes to the arrangement.

ART.2 - PRODUCT QUALITY

Although our supply is daily and the lifespan of the flowers is variable, we cannot be held responsible for variations in the lifespan of our flowers or failure to observe common sense rules (lack of water, exposure to high or low temperatures).

ART.3 - THE GUARANTEE

We do our utmost to ensure that the flowers and plants remain with our customers for a long time by taking the necessary care and preparation to deliver a 1st quality product. If the quality of our service requires a complaint (damaged flowers), you must return the arrangement within 2 days of delivery so that we can examine and possibly replace the item. We will do our utmost to find a solution and satisfy you.

ART.4 - DELIVERY TIMES

Deliveries are made in the morning or afternoon. Once your order has been placed, you will receive an order confirmation by e-mail. If certain flowers in our range are sold out, we reserve the right to deliver a similar product. If there are no similar products available, we will contact you either by e-mail or by telephone to inform you and offer you an alternative. If we are unable to contact you, the order will be put on hold and cancelled after 5 days without any news from you. No fee will be charged. If you have any special requirements, we advise you to place your order at least 48 hours before delivery by telephone on 022 771 48 43 during business hours.

ART.5 - DELIVERY SCHEDULE

All year round, except :

- Saturday afternoons, Sundays and public holidays.

- Valentine's Day - 14 February: due to the considerable volume of orders placed on this day, Valentine's Day orders may be subject to exceptional deliveries from 12/13 February, particularly for professional delivery addresses.

- Mother's Day: orders placed for Mother's Day will only be delivered on the Saturday morning before Mother's Day.

ART.6 - ACCURACY OF THE DELIVERY ADDRESS

Please ensure that the delivery address and local telephone number on your order are correct and complete. We accept no responsibility for late or non-delivery due to an incorrect or incomplete address. In order for your order to be processed as quickly as possible by our florists, the following information may also be useful:

- For deliveries to hospitals, it is advisable to indicate the department and room number.

ART.7 - DELIVERIES IN GENEVA AND THE SURROUNDING AREA

Deliveries are made on rounds. We guarantee that the delivery date and time slot will be respected, except in cases of force majeure. In the event of a false or incomplete address, we will contact you by e-mail or telephone and put the delivery on hold. We reserve the right to invoice the delivery costs twice if we have to return the goods following an error on your part. If the recipient is absent, we will leave the flowers on their doorstep. Our delivery personnel will ensure that the flowers do not dry out by providing a container with water if necessary, and will judge whether or not it is safe to leave them outside the door. They can also leave the flowers with neighbours, the caretaker or someone else. As a general rule, the bouquet will be left even if you are absent. Under no circumstances can we be held responsible for the theft of flowers left outside the door. We deliver our flowers to the date and address indicated on the order. It is preferable for our customers to ensure that the recipient is at home on the day of delivery.

ART 8 - ORDER CONFIRMATION

For each order placed, an order confirmation will be sent to you by email. This will contain your order number and details of the item(s) purchased, the price, the delivery date and the sender's and recipient's addresses. If you do not receive confirmation of your order, please contact our Customer Service department directly on 022 771 48 43.

ART.9 - PRICE OF FLOWERS

The price varies according to the season and will be that in force on the day the order is placed. The prices indicated on our website include VAT. A surcharge is levied for delivery costs. This is CHF 18 for delivery in Geneva. (or its equivalent in € or $, depending on the currency selected when the order was placed). This amount is indicated on the order details. This amount is variable if the delivery is in the Geneva area.

ART.10 - PAYMENT

The prices displayed on the site are inclusive of VAT. As a general rule, orders placed on our E-commerce site are only accepted with payment by credit card. Only payments in CHF, EURO and USD are accepted. The exchange rate applied corresponds to the official rate of the day. It may differ slightly from the rate applied by your credit institution. In the event of invoicing in another currency by your credit institution, the exchange rate applied will correspond to the official rate of the day applied by your credit card company.

ART.11 - CONFIDENTIALITY

Under no circumstances do we give your information to third parties and we only use it to process your order. We do not use your information to send advertising from other companies. We reserve the right to send you from time to time a newsletter or information concerning the activities of our company, Bouvard fleurs SA. You can unsubscribe from our newsletters at any time and you can also be removed from our customer files by entering your login, e-mail address and password. If you forget your password, you can ask us for a new one.

ART.12 - CANCELLATION AND RIGHT TO CANCEL THE ORDER

All flower orders may be cancelled up to one working day before the desired delivery date. To do this, it is essential to indicate the number of the order concerned.

Orders cancelled after this time cannot be accepted. In such a case, we cannot guarantee a refund of the value of the order.

Monday: 07:00 - 12:00 / 14:00 - 16:00

Tuesday to Friday: 07:00 - 12:00 / 14:00 - 18:00

Saturday: 07:00 - 12:00

Sunday: no delivery

All visuals, photos, texts and comments reproduced on the Bouvard Fleurs SA website and e-commerce site are subject to copyright and intellectual property rights throughout the world. Any total or partial reproduction of the site is therefore strictly prohibited.

ART.14 - PLACE OF JURISDICTION

We respect Swiss law and apply it in the operation of our company. The place of jurisdiction is Geneva.
